CUSTOMER PRIVACY
POLICY
Disclosure of Nonpublic Personal Information
The
Board of Directors of Fidelity Bank, National
Association, is committed to complying with all consumer
and commercial laws and regulations. In November 1999,
Congress passed the Gramm-Leach-Bliley Act, related to
the privacy of bank customer information. That Act
becomes effective July 1, 2001. This policy sets forth
the general guidelines set by the Bank to protect the
security and confidentiality of its customers’
“nonpublic personal information”.
General Statement
The
Board of Directors recognizes the responsibility of the
Bank and its employees to safeguard the financial
records and personal information of the institution’s
customers, and the Bank employees.
The term
customers shall include all consumer customers who have
a continuing relationship with the Bank such as:
Deposit account, Loan account, Credit card, Safe deposit
box, Retail installment contract we hold and service,
financial, investment, or economic advisory services
(for a fee) or home mortgage brokerage.
The term
Nonpublic personal information shall mean information
about the customer that the Bank collects in connection
with providing a financial product or service to a
customer. Nonpublic personal information does not
include information that is available from public
sources, such as telephone directories or government
records.
An
Affiliate is a company the Bank owns or controls, a
company that owns or controls the Bank, or a company
that is owned or controlled by the same company that
owns or controls the Bank. Ownership does not mean
complete ownership, but means owning enough shares to
exert have control.
A
nonaffiliated third party is a company that is not an
affiliate of the Bank.
The Bank
collects nonpublic personal information about customers
from the following sources:

Information received on applications or other forms

Information about transactions with the Bank
-
Information about transactions with nonaffiliated
third parties

Information from a consumer reporting agency
The Bank
will NOT disclose any nonpublic personal information
about any customer or Bank employee, to anyone, except
as permitted by law. The Bank restricts access to
nonpublic personal information about customers to those
employees who need to know that information to provide
products or services to customers. The Bank maintains
physical electronic, and procedural safeguards that
comply with federal standards to guard nonpublic
personal information. The Bank will not disclose
nonpublic personal information about former customers,
except as permitted by law.
